A team of lawyers representing the Assets Recovery & Property Retrieval Team headed by its chairperson, Cllr. Edwin Kla Martin is set to make legal representation before the Full Bench of the Supreme Court of Liberia on Thursday, July 4, 2024 in a case involving Gracious Ride Inc.

The Assets Recovery & Property Retrieval Core Team was constituted by President Joseph N. Boakai through Executive Order No. 126. The Team was charged to ensure processes leading to the location, recovery, and retrieval of public resources and properties.

The case currently before the Supreme Court for argument, is based on Gracious Ride’s appeal to the Full Bench following a petition for writ of prohibition filed by their legal team.

The petition is seeking to stop the Task Force operation, which was denied by Justice in Chamber Yusuf D. Kaba.

Justice Kaba earlier ruled: “By directive of His Honor, Yusif D. Kaba, Associate Justice presiding in Chambers, and considering the attached communication from the respondent, you are hereby informed that the Justice has declined to issue the writ prayed for by the petitioner, reserving the rights to the respondent to proceed in keeping with the law.”

However, following the ruling, Gracious Ride proceeded to the full bench of the Supreme Court questioning the legal status of the President to create an Asset Recovery Team.

At the same time, the task force and the Ministry of Justice have asked the Supreme Court to strike out the petitioner’s petition from the court’s docket based on their inability to cite constitutional provisions that render the act of the President to issue Executive Order No. 126 that created the Taskforce.
